What Type of Information Does Crocs Collect?

We collect two types of information from visitors to the Website, “Automatic Anonymous Information,” or “AAI,” (which does not, in and of itself, identify you personally) and “Personally Identifiable Information,” or “PII” which is individually identifiable information about you that could permit one to identify or contact you.

Information You Manually Provide. You may provide PII voluntarily when using our Website, for example when making a purchase, registering an account, entering a contest or sweepstakes, filling out a survey, or providing Feedback. Certain fields may be required to access specific features or services. You may choose not to provide this information; however, some Website services or features may be unavailable if you do not provide it.

Payment Information. If you make a purchase through our Website, your payment‑related personal data (such as billing name, contact details and transaction information) will be processed for the purpose of completing the transaction. Payment processing is carried out by our authorised third‑party payment service providers. We do not store your full credit or debit card details on our systems.

Information From Third-Party Social Media Platforms. You may choose to register or log in via a third-party social media platform. By doing so, you consent to the sharing of information from your profile on that platform with Crocs, which we treat in the same manner as information you provide directly to us.

Information Sent to Us by Your Web Browser. We may automatically receive certain information from your web browser when you access our Website. This information may include your IP address, the web page you visited immediately before accessing our Website, your operating system, browser type and version, and the date and time of your visit. The specific information we receive depends on your browser settings, which you may review or modify to control what information is shared.

We use this information to improve the functionality, performance, and content of our Website and to better understand and serve our visitors. On its own, this information does not identify you personally. However, we may combine it with other information, including Personally Identifiable Information (PII) you provide, in order to enhance your experience and provide personalized services, in accordance with the PDPA 2010.

Information From Your Mobile or Tablet Device. If you access our Website via a mobile or tablet device, we may automatically collect certain information from or about your device. This information may include the type of device, its IP address, operating system, and the type of mobile or tablet browser used.

Information Collected Using “Cookies” and Other Web Technologies. We may use cookies and similar technologies to enhance your experience on our Website. Cookies are small text files stored on your device that help us remember your preferences, items in your shopping cart, or login details, and may include certain PII. For example, if you select the “remember me” option during login, we may store your email address in a cookie to expedite future logins. Cookies may also be used to deliver “first-party” advertisements tailored to your interests.

Use of cookies is not required to browse our Website; however, certain features, including the shopping cart and checkout functions, may not work properly without them. If you wish to place an order without enabling cookies, please email Customer Service.

In addition to cookies, we may use web beacons and other similar technologies to help manage our Website and emails. Web beacons are small pieces of code that allow us to count visits to a web page or determine whether an email has been opened. We may link information collected through web beacons and other technologies to PII in accordance with the PDPA 2010.

More Information On “First Party” Advertising

First-party advertising works as follows: When you visit our Website, we may deliver a cookie to your browser. When you leave our Website and navigate elsewhere on the Internet, we may use the cookie to recognize you as someone who has visited our Website, to assume that you are interested in our products, and to deliver an advertisement promoting our products. Although we may work with vendors to deliver and read our first-party cookies and to serve advertisements on our behalf, these vendors are prohibited from using these first-party cookies to identify you personally or to recognize your interest in goods or services of the vendors’ other clients.

You may opt out of first-party advertising by clicking here. When you do so, we will deliver an “opt-out” cookie to your browser. When you visit our Website in the future, the opt-out cookie will indicate that you have opted out of Crocs’ cookies for first-party targeted advertisements.

Please note that the opt-out cookie only prevents delivery of first-party advertising cookies. First-party cookies are distinct from third-party cookies. Third-party cookies may track your online activities across non-affiliated websites to deliver targeted advertisements not only for Crocs but also for other companies. Any collection or use of your PII via cookies is conducted in compliance with the PDPA 2010. For more information on online behavioral advertising and your choices regarding third-party cookies, please refer to the next section.

Cookies Delivered by Third Parties

In addition to the cookies delivered by Crocs to your device through our Website, certain third parties may also deliver cookies to your device for various purposes. For example, we use Google Analytics, a web analytics tool that helps us understand how visitors engage with our Website. To learn more about Google Analytics, click here. Other third parties may deliver cookies to your computer for the purpose of tracking your online behaviors across non-affiliated websites and delivering targeted advertisements either on our Website or on other websites.

You have choices about the collection of information by third parties on our Website. For example, if you don’t want information about your visit to our Website sent to Google Analytics, you may download an Opt-out Browser Add-on by clicking here. Please note that the Add-on does not prevent information from being sent to Crocs.

In addition, if you would like to opt-out of having interest-based information collected by certain third parties during your visits to our Website or other websites, you may click here. You will be directed to an industry-developed website that contains mechanisms for choosing whether each listed entity may collect and use data for online behavioural advertising purposes. Some the third parties that collect interest-based information on our Website do not participate in this industry-developed opt-out website, in which case the best way to avoid third-party tracking of your online behaviors may be through your browser settings and deletion of cookies. Please note that the opt-out mechanisms on the industry-developed website are device-specific. If you wish to opt out across all devices, you will need to complete the opt-out process separately for each device.

However, some third-party service providers may use information collected through this Website for their own marketing purposes, or to market the products and services of their other clients:

For more information about behavioral advertising, see the “Cookies Delivered by Third Parties” section above.

Your Choices

In General. We respect your rights under the PDPA 2010 to make choices regarding the collection, use, and disclosure of your PII on or through this Website. We aim to provide such choices at meaningful times and in meaningful ways. This section describes some of the choices available to you, including your ability to opt out of receiving cookies.

Do Not Track Mechanisms. Your browser may deliver a “Do-Not-Track (‘DNT’) signal” to this Site. Due to the evolving nature of technology and industry standards, we do not currently guarantee that we will respond to or honor DNT signals.

Previously Expressed Preferences. You may update or change preferences you previously expressed regarding the use of your PII. For example, if you have provided your contact information and are receiving periodic emails from us, you may opt out at any time by clicking the “unsubscribe” link in the footer of the email. You may also be able to change other preferences through an account you create on this Website. If not, please contact us using the information provided in the “Contact Us” section.

Steps We Take to Safeguard your Information

We maintain reasonable administrative, physical and technological measures to protect the confidentiality and security of PII you submit on or through our Website in accordance with PDPA 2010. For example, when collecting credit card information for online purchases, we offer secured-service transactions that encrypt your information during transmission to prevent unauthorized access or misuse.

However, no website, server, or database is completely secure or “hacker-proof.” Consequently, we cannot guarantee that your PII will not be disclosed, misused, or lost due to accidental events or unauthorized acts by third parties. Additionally, we cannot control the dissemination or use of PII contained in User-Generated Content you post on or through our Website, and you should not expect privacy for such information.

We will retain your personal information only for as long as necessary to fulfil the purposes for which it was collected or to comply with legal, regulatory, or internal policy requirements. We also implement retention measures to ensure that PII in our possession or under our control is destroyed or anonymized as soon as reasonably practicable when, (i) the purpose for which the PII was collected is no longer being served by its retention; and (ii) retention is no longer required for any other legal or legitimate business purposes.

Personal Data Breach

In the event of a personal data breach that is likely to result in a risk to your rights and freedoms, we will take reasonable steps to assess and contain the breach and, where required under applicable law, notify the relevant authorities and affected individuals within the time prescribed by law.

How Does Crocs Share the Information it Receives?

Crocs may share the PII and/or Automatic Anonymous Information (“AAI”) you submit on or through this Website in the following ways:

Third–Party Service Providers. Crocs shares information collected through this Website with third-party service providers who act for or on our behalf. For example, we may use third-party vendors to design, operate, or host our Website; to conduct surveys; or to assist with our promotional efforts. These service providers may require access to your PII in order to perform their functions. Typically, third-party service providers who receive PII are bound by contract to use it only on our behalf

However, our third-party service providers may be allowed to use two types of information collected through this Website for their own marketing purposes and/or to market the products and services of their other clients. First, we may permit third-party service providers to use aggregate information about how users of this Site behave to market either their own products and services or the products and services of their other clients. Aggregate information provides a picture of how our users behave collectively—it typically does not provide a picture of how any single individual has behaved on our site. Second, we may permit third-party service providers to use AAI collected through this Website to market either their own products and services or the products and services of their other clients. AAI is information about a particular individual (such as a user’s IP address) but it does not, standing alone, identify the individual. For more information about behavioral advertising, see the “Cookies Delivered by Third Parties” section above.

Other Users of This Website. User-Generated Content you submit on or through our Website may be visible to others who visit the Website. Any PII contained in User-Generated Content may be read, collected, shared, or used by others, including to send unsolicited messages. Crocs may also use User-Generated Content for advertising campaigns or promotions. We may or may not use your name in connection with such content and may or may not seek your consent before doing so.

You should have no expectation of privacy in User-Generated Content submitted on or through our Website. Please do not submit content you do not wish to make publicly available and ensure that your submissions comply with our Terms of Use and do not infringe the rights of others.

Third-Party Social Media Platforms. We may share your email address or phone number with third-party social media platforms to confirm your use of the platform, which allows us to advertise to you through it. These platforms may use this information for their own marketing purposes, but they are prohibited from retaining or using any email address or phone number provided to them that does not already exist in their database. You may also choose to post information about your actions on our Website to a third-party social media platform.

If you do, users with access to your profile on that platform may see your actions. You should have no expectation of privacy regarding such actions. Linking your Website profile to a third-party social media account may result in sharing your profile information with that platform.

Affiliates and Subsidiaries. We may share your information with our affiliates and subsidiaries for their own marketing purposes. We may offer you the opportunity to opt out or opt in, as required under Malaysian law.

Business Partners. Crocs may share your information with selected third parties (other than service providers, affiliates, or subsidiaries) for their own marketing purposes, in accordance with applicable law. If a contest or promotion is co-branded with another party, you may not be able to opt out of sharing your information with the co-sponsor. Participation in such contests or promotions is voluntary.

Business Negotiations. We may contemplate, for strategic or other reasons, selling, buying, merging, or otherwise reorganizing one or more of our businesses. In negotiating with a third party about entering into such an arrangement, and in completing the transaction, we may need to disclose your information. In such cases, we will take reasonable measures to protect the information we disclose, for example, by requiring a prospective purchaser to sign a non-disclosure agreement limiting the use and protecting the confidentiality of the information.

Business Transfers. We may transfer the information you submit on or through our Website to any organization that, in whole or in part, acquires or merges with us, prior to and in connection with such transaction. Such information will be protected to the extent required by law.

Compliance With Laws and Protection of Rights. Crocs may disclose or transfer your information to comply with legal obligations, cooperate with law enforcement, protect our rights, or prevent fraud. This may include investigations into illegal activity or actions that could expose Crocs or you to legal liability under Malaysian law.

As Described in a Privacy Notice. We reserve the right to disclose your information as described in any privacy notice posted on a page of our Website where you provide that information. By providing your information on that page you will be consenting to the disclosure of your information as described in that privacy notice.

As Described in a Click–Through Agreement. Crocs may disclose your information as described in any privacy notice posted on a page of our Website where you provide information or as set out in any click-through agreement you have accepted.

Links to Other Sites

This Privacy Policy applies only to our Website. You may access other websites through links on our Website. Please note that these other websites may collect, use, or disclose your PII or Automatic Anonymous Information (AAI) according to their own privacy policies.

The information practices of websites linked from or to our Website are not covered by this Privacy Policy, and Crocs is not responsible for the privacy practices or content of such linked sites. We strongly encourage you to exercise caution and review the privacy policies of any third-party websites before disclosing your PII.

If you register for Crocs services on another website or use a third-party website that provides services on behalf of Crocs, that website may provide PII or AAI about you and your transactions back to Crocs, in accordance with the PDPA 2010 and other applicable laws.

Accessing and Updating Your Information

You always have the opportunity to review and update the PII you provide to us by logging into the Website and entering the new information yourself. You can edit your name, contact information, and preferences by logging into the “My Account” section of the Website.

You may also submit a written request to access the PII currently in our possession or control. In order to process your request, we will require sufficient information from you to verify your identity and to ascertain the nature of your request. Please submit your written request at the following webpage and using the online form set out therein.

Upon receiving a complete request, we will endeavor to provide you with the relevant PII within 30 days. If we are unable to respond within this period, we will notify you of the earliest possible time by which we can provide the information requested. Please note that under the PDPA 2010, certain types of PII may be exempted from access requests.

A reasonable fee may be charged for handling and processing your access request. We will provide you with a written estimate of the fee in advance. Please note that we are not obliged to respond to your request unless you agree to pay the applicable fee.

Administration And Management Of PII

We take reasonable steps to ensure that your PII is accurate and complete, particularly if it is likely to be used to make decisions affecting you or disclosed to another organization. To assist us in maintaining accurate PII, you should promptly update us with any changes to the information you have previously provided. Crocs will not be responsible for any consequences arising from relying on inaccurate or incomplete PII if you fail to notify us of changes.

A Special Note About Children’s Privacy

Our Website is intended for use by individuals who are 13 years of age or older. If you are under 18 years old, you must obtain the consent of a parent or guardian before providing any Personal Information (PII) to us or registering on our site.

We do not knowingly collect, use, or disclose PII from children under the age of 13 without the consent of a parent or guardian. If you are under 13, you may only use this Website with the involvement and permission of your parent or guardian.

Parents or guardians who believe that their child has provided PII to us without their consent may contact us to request that such information be deleted.

Privacy Policy Changes

Crocs reserves the right to change, modify, add, or remove portions of this Privacy Policy at any time, without prior notice, by posting the revised version on our Website. Your continued use of the Website following any such change constitutes your agreement that all information collected from or about you after the revised Privacy Policy is posted will be subject to the terms of the revised Privacy Policy.

To alert you to changes, we will provide a notice at the top of this Privacy Policy for at least 30 days after the new effective date. Unless the change is minor (such as a change in our contact information) or non-substantive (such as formatting updates), we will also post notices (a) on our home page and/or on relevant pages of our Website, and (b) on any notices summarizing highlights of this Privacy Policy for 30 days after the new effective date.

From time to time, for example, due to changes in the law, technology, or our business operations, we may ask for your express consent to use the PII we have collected from you in new or different ways. We will do this by sending a notice to the last email address you provided and requesting your agreement. If you do not provide your consent, we may, at our discretion, delete all or part of your PII from our databases to avoid using your information in ways for which we do not have consent.

You may access the current version of this Privacy Policy at any time by clicking on the “Privacy Policy” link at the bottom of each page of our Website.

Transfer of Data Abroad

If you are visiting this Website from a country other than the countries in which our servers are located, the various communications will necessarily result in the transfer of information across international boundaries. By visiting this Website and communicating electronically with us, you consent to the collection, use, processing, storage, and transfer of your data as set out in this Privacy Policy.

In certain cases, sometimes data collected (whether electronically or otherwise) in one country may be processed and managed centrally in another by our affiliates and/or third parties. By providing your PII or AAI, you consent to its transfer to and processing in other countries as necessary. Where we transfer your PII or AAI, please be assured that it will be handled in accordance with this Privacy Policy, relevant laws and best practices.

Where your PII is to be transferred out of Malaysia, we will comply with the PDPA 2010. In particular, we will take reasonable steps to ensure that the foreign recipient organisation is bound by legally enforceable obligations to provide a standard of protection for the transferred personal data that is at least comparable to the protection under the Act.
